Board of Adjustment Information

The Zoning Board of Adjustment is responsible for considering applications that require exceptions from standards in the Township’s Development Regulations Ordinance. This body also hears appeals from decisions made by the Township’s Zoning Officer. Pursuant to the Municipal Land Use Law, the Township imposes on an applicant fees and costs to recover expenses incurred in processing applications. Depending on the schedule of the Zoning Board and complexity of the application, the period to complete the process is generally between two (2) and nine (9) months. Assistance in the application process is available in the Planning & Zoning Department.

A Guide to Planning Board and Board of Adjustment Meetings

Introduction

All Board meetings are run by the respective Chairman. The Board must have a majority of its members present – 4 Board of Adjustment and 5 Planning Board – in order to proceed. The Board follows parliamentary procedure (Roberts Rules of Order) to conduct meetings in an efficient and orderly manner. All meetings are conducted in accordance with the Open Public Meetings Act (Chapter 231,

P.L. 1975), commonly referred to as the “Sunshine Law.” The Boards and Board Members have the obligation to follow the Municipal Land Use Law (MLUL), and are compelled to act based on the findings of fact and proofs provided during the course of the public hearing. The Board of Adjustment and Planning Board function as quasi-judicial bodies, meaning they operate similar to a court of law.  All discussions, presentations of evidence, questions and comments regarding a pending application must be conducted before the public except for certain matters related to litigation.

For information about a specific meeting or application please feel free to contact the Planning & Zoning Department at 908-369-4313.
